How Adultery Can Affect Your Alimony Claim

While receiving alimony in North Carolina does not require fault on the part of the supporting spouse, it can be a significant factor in these cases. If a supporting spouse commits adultery in the days or weeks preceding a separation, then that supporting spouse may be required to pay alimony under North Carolina law. However, if both spouses have committed adultery during the marriage, the dependent spouse may be prohibited from obtaining alimony. If a dependent spouse commits adultery while the supporting spouse was faithful during the marriage, then the dependent spouse may be prohibited from receiving alimony.
